Terms of Service

These Terms of Service ("Terms") are a contract between you and PalmSpeak, the operator of palmspeak.com. By creating an account or using PalmSpeak in any way, you agree to be bound by these Terms. If you don't agree with any part of them, please don't use the service.

We've written these Terms in plain English so they're actually readable. If anything is unclear, email [email protected].

PalmSpeak is a language-learning service available on the web and as an installable Progressive Web App. It lets you practise conversation in supported languages (currently Korean, Thai, Chinese, Japanese, Spanish, French, German, English, Italian, and Portuguese) by chatting with an AI tutor or having live voice conversations with other users who are native speakers. You can save vocabulary, review past sessions, and track your progress.

We're a small independent product, and we're constantly improving the service. Features may be added, changed, or removed over time.

You must be at least 13 years old to create a PalmSpeak account. If you're between 13 and the age of digital consent in your country, you need a parent or guardian's permission to use the service.

PalmSpeak is for individuals using the app for their own personal language learning. You may not use the service through bots, scripts, scrapers, or any other automated means. You may not use PalmSpeak to provide a derivative service to others or to resell access to it.

You're responsible for keeping your account credentials secure. Don't share your password, and don't let other people use your account. If you think someone has gained access to your account, change your password and let us know at [email protected].

One person, one account. If we detect multiple accounts belonging to the same person — particularly when used to circumvent free-tier limits — we may merge or suspend them.

You're responsible for everything that happens under your account, including any conversations you have with human chat partners.

PalmSpeak is meant to be a friendly, supportive space for people learning a new language. To keep it that way, when you use the service, you agree not to:

• Harass, threaten, insult, or otherwise mistreat human chat partners or any other users
• Use the service for any unlawful purpose
• Attempt to access other users' accounts or data
• Scrape, copy, or otherwise extract content from the service in bulk
• Reverse-engineer or attempt to discover the source code of the service
• Try to circumvent rate limits, free-tier restrictions, or other usage limits
• Upload malware, phishing links, or harmful content
• Impersonate someone else, including PalmSpeak staff
• Use the service in any way that interferes with other users' ability to use it

We may add to this list as new issues come up. Violating these rules can result in suspension or termination of your account.

PalmSpeak has a free tier with certain feature limits, and a paid plan called Unlimited that removes those limits.

The Unlimited plan costs $17.99 per month or $129 per year, billed in advance through Stripe. Prices may change, but we'll give you notice before any change applies to your subscription. By subscribing, you authorise us (through Stripe) to charge the payment method you provide on a recurring basis until you cancel.

You can cancel your subscription at any time from your account settings. When you cancel, you'll keep Unlimited access until the end of the billing period you've already paid for, and then your account reverts to the free tier. We don't pro-rate unused time for monthly plans.

For annual plans, we offer a 7-day refund window: if you cancel within 7 days of your initial annual purchase or renewal, we'll refund the annual fee in full. After 7 days, annual plans are non-refundable, but you'll keep access until the end of the year you've paid for. Monthly plans are not refundable, since you can cancel at any time and only pay for the month you're in.

If a payment fails, we'll try to charge again over the following days. If we still can't collect payment, your account will be moved to the free tier until billing resumes.

PalmSpeak — including the website, the software, the AI tutor's prompts and behaviour, our brand, the design, and all the underlying technology — is owned by us. You're granted a personal, non-exclusive, non-transferable, revocable licence to use it as intended.

You retain ownership of any content you contribute: your messages in conversations, vocabulary you save, audio you record, and anything else you produce while using the service. By using PalmSpeak, you grant us a limited licence to store, process, and display your content as necessary to operate the service for you. We don't claim ownership of your content, and we don't use your conversations to train AI models.

The output you receive from the AI tutor is generated for you to use freely. AI-generated content may occasionally be inaccurate or inappropriate — please don't rely on it as authoritative advice for anything outside of language learning.

The live human chat feature exists because conversations with real native speakers are one of the most effective ways to learn a language. To make this work, both people on a call need to feel respected and safe.

When you take part in a human chat session, you agree to:

• Be respectful, polite, and patient with your conversation partner
• Not use offensive, sexual, discriminatory, or threatening language
• Not record, screenshot, or otherwise capture the audio of your session outside of what the app itself stores
• Not share personal contact details within a session, or solicit them from your partner
• Not attempt to take the conversation off the platform
• Not use sessions for romantic solicitation, sales pitches, recruitment, or any purpose other than language practice
• Report partners who behave inappropriately, using the in-app reporting tools

If you behave inappropriately during a human chat session, we may suspend your access to human chat or to PalmSpeak as a whole, depending on the severity. Serious violations (such as harassment, threats, or sexual misconduct) will result in immediate termination.

When a report is filed against you, we may review the relevant session transcript to investigate. By using human chat, you understand that your conversations there are subject to this kind of safety review.

PalmSpeak is provided "as is" and "as available". We do our best to keep the service running, accurate, and useful, but we don't promise that it will always be available, error-free, or fit for any particular purpose. The AI tutor can make mistakes — its responses are generated content and may sometimes be incorrect or unsuitable.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, PalmSpeak and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes loss of data, loss of profits, loss of learning progress, or any damages arising from your interactions with other users on the platform.

Our total liability to you for any claim relating to PalmSpeak will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $50.

Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud or gross negligence.

You can stop using PalmSpeak at any time by deleting your account from your settings. Deleting your account does not entitle you to a refund except as set out under "Subscriptions and billing" above.

We may suspend or terminate your account if we believe you've violated these Terms, if your account has been inactive for an extended period, or if we need to do so to protect the service or other users. Where reasonable, we'll let you know why and give you a chance to respond. For serious violations, we may terminate immediately and without notice.

Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability — will continue to apply even after your account ends.

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date at the top of this page and, if the change significantly affects your rights or obligations, we'll email you at least 30 days before the change takes effect. Continuing to use PalmSpeak after a change takes effect means you accept the updated Terms.

If you don't agree to a change, you can stop using the service and cancel your subscription before the change applies.
